TERMS AND CONDITIONS OF STAY AT THE WAVES APARTMENT

1. Definitions

• "Guest": Individual(s) booking/staying at the Property.

• "Booking": Reservation of the Property via our platform/agent or by any other means.

• "Property": The luxury serviced apartments known as The Waves Apartment, located

at Surulere in Lagos, Nigeria.

• "Management": the managers of the Property and any of its representatives.

2. Booking & Payment

• Reservations: Subject to availability.

• Details: Guest must provide accurate details (names, contact info, dates).

• Deposit: 50% non-refundable deposit required to confirm booking.

• Payment Methods: Bank transfer, credit/debit card, or approved mobile money

platforms.

• Security Deposit: A Refundable deposit of N50,000 is required for damages/incidents.

Refunds are to be processed within three working days post-checkout. This amount

is subject to deductions and withholding in the event of any damage to the items at

the Property, and the Guest may be required to top up the Security Deposit if the cost

of repairs exceeds the deposit paid.

3. Cancellation & Refunds

• Guest Cancellation: where the Guest cancels more than 30 days before the check-in

date, the guest shall be entitled to a full refund. If the Guest cancels less than 30 days

but more than 7 days before check-in, the guest shall receive a 50% refund. If the

cancellation is less than 7 days prior, there shall be no refund.

• Management Cancellation: Full refund if the Property becomes unavailable due to

unforeseen circumstances.

4. Check-In/Check-Out

• Check-In: 2:00 PM. Late arrivals must notify Management. Early check-in is subject

to availability and shall attract 50% of the daily rate.

• Check-Out: 11:00 AM. Late departures are charged 50% of the daily rate. Departures

after 5 pm attract the full rate.

• ID Verification: Valid government-issued ID required at check-in.

5. House Rules

• Occupancy: Maximum 4 guests per apartment. Unauthorized guests may incur fees.

• Noise: Quiet hours from 10:00 PM to 7:00 AM. At all other times, Guests should

maintain quiet and decorum.

• Smoking: Strictly prohibited inside the apartments and public spaces of the apartment

(smoking permitted in the balconies only, please use an ashtray).

• Drugs: the use of Illegal or controlled drugs and substances on the Premises is

prohibited.

• Pets: Not allowed

• Damages: Intentionally or negligently causing damage to the Apartment, its contents,

or common areas. The Guests are liable for repair/replacement costs, with the initial

payment to be taken from the Security Deposit.

• Conduct: Illegal activities, parties, or disruptions may result in immediate eviction

without refund.

• Acts of Violence: Committing, threatening, or inciting violence against any person,

including but not limited to, assault, battery, and murder are prohibited.

• Harm to Self or Others: Engaging in, encouraging, or assisting in any form of self-harm,

suicide, or euthanasia, as these are serious matters with potential legal ramifications,

is prohibited. Management reserves the right to contact emergency services and law

enforcement if there is a concern for the safety or well-being of any occupant.

• Disruptive or Offensive Conduct: Behaving in a loud, obnoxious, or offensive manner

that disturbs the rights, comfort, health, and safety of other residents or property

employees. This includes activities related to practices such as voodoo or any barbaric

practice that may involve loud noise, public disturbance, or other activities that breach

the peace or violate animal cruelty laws.

6. Liability & Insurance

• Guest Responsibility: Use the Property at own risk. Management is not liable for

accidents, injuries, or loss/theft of belongings:

• Indemnification: Guest agrees to indemnify Management against claims arising from

their stay.

• *Insurance*: Guests advised to obtain travel/property insurance.

7. Data Protection

• Complies with Nigeria's NDPR (Nigeria Data Protection Regulation).

• Personal data collected for booking purposes only; not shared with third parties without

consent.

8. General Provisions

• Right of Entry: The Management has the right to enter the Premises at all reasonable

hours for inspections or repairs, after giving prior notice (except in emergencies).

• Liability: Management is not liable for accidents, injuries, or loss/theft of personal

belongings. Guests are advised to obtain travel or property insurance.

• Fire Safety and Precautions: The safety and security of all guests and the property are

paramount. The guest is required to adhere strictly to all fire safety regulations and

instructions provided by the Management, in compliance with the relevant fire safety

standards in Lagos, Nigeria.

• No Open Flames: The use of open flames, including but not limited to candles, incense,

or any form of outdoor/indoor fire pits, is strictly prohibited inside the apartment or on

balconies.

• Appliance Use:

- Do not overload electrical sockets or extension leads with too many appliances.

- Do not use personal electrical appliances (hairdryers, chargers, etc.) that appear

damaged or faulty.

- Do not leave cooking or ironing equipment unattended while in use.

- Flammable Materials: Do not store or bring onto the Premises any articles of a

combustible, inflammable, or dangerous nature (e.g., petrol, gas cylinders, etc.)

that could cause an increased fire risk or void the building's insurance policy.

9. Termination

• Management reserves the right to terminate stays for:

- Breach of House Rules.

- Non-payment.

- Safety/legal concerns.

• No refunds provided upon termination.

10. Dispute Resolution & Governing Law

• Mediation: Parties agree to mediate disputes before litigation.

• Jurisdiction: Governed by the laws of Lagos State, Nigeria. Legal proceedings

11. Amendments

Terms subject to change. Guests are bound by the latest version at the time of booking.

12. Acknowledgement

By booking, the Guest confirms understanding and acceptance of these Terms.
